  • Damage resulting from frozen pipes due to customer failure to winterize

8.4 Warranty Claim Process

Fenyes Pasa Plumbing shall not be held liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters including earthquakes, floods, or mudslides affecting Los Angeles County or the San Gabriel Valley
  • Wildfires or mandatory evacuation orders affecting Pasadena, CA or surrounding communities
  • Severe weather events impacting service delivery or technician safety
  • Government-mandated restrictions, orders, or declared states of emergency
  • Supply chain disruptions affecting availability of parts and materials
  • Labor shortages or strikes affecting the plumbing industry
  • Pandemic or public health emergencies declared by local, state, or federal authorities
  • Power outages or infrastructure failures affecting our operations
  • Acts of terrorism or civil unrest

In the event of a force majeure situation, Fenyes Pasa Plumbing will make reasonable efforts to notify affected customers and reschedule services as soon as conditions permit.

18. Dispute Resolution & Governing Law

18.1 Governing Law

These Terms and Conditions, and any disputes arising from or related to them or to any services provided by Fenyes Pasa Plumbing, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

18.2 Jurisdiction & Venue

Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the Superior Court of Los Angeles County, California, or the appropriate federal court serving the Central District of California. Both parties consent to personal jurisdiction in such courts.

18.3 Informal Resolution — First Step

Before pursuing formal legal action, both parties agree to attempt to resolve any dispute through good faith direct negotiation. The complaining party must provide written notice of the dispute to Fenyes Pasa Plumbing at fenyespasaplumbing@gmail.com or by mail to 212 S El Molino Ave Suite 3, Pasadena, CA 91101. Both parties will have 30 calendar days from the date of notice to attempt informal resolution.

18.4 Mediation

If informal negotiation does not resolve the dispute, both parties agree to submit the dispute to non-binding mediation before a mutually agreed-upon mediator in Los Angeles County, California, with costs shared equally unless otherwise agreed.

18.5 Arbitration

If mediation is unsuccessful, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Los Angeles County, California. The arbitrator's decision shall be final and binding on both parties.

18.6 Class Action Waiver

You expressly agree that any dispute resolution proceedings — whether through informal negotiation, mediation, arbitration, or litigation — will be conducted solely on an individual basis. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any representative action against Fenyes Pasa Plumbing.

18.7 Limitation on Claims

Any claim or cause of action arising from these Terms or Fenyes Pasa Plumbing services must be filed within one (1) year from the date the claim arose, or it shall be permanently barred, to the fullest extent permitted by California law.

19. Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions. The severed provision shall be replaced with a valid, enforceable provision that most closely reflects the original intent of the severed provision.
